The French Exit: Things I have long wondered about

1. In The Secret of My Success, there's a line I have never understood. The Michael J. Fox character is driving Aunt Vera back to her house in the country and eavesdrops on her car-phone conversation. She says (of her husband), "The last one I caught him with was so dumb, she thought 'dictation' was some kind of S&M trip." As a kid, I thought maybe this supposed bimbo was combining the words "dick" and "vacation" to arrive at this meaning of "dictation." But even in the '80s I knew this wasn't a very good joke; dicks don't necessarily entail bondage. Twenty-odd years later I still don't know what this joke means. Because he's telling her what to type, she thinks it's like a dom-sub situation? What the hell is going on here?


2. You know how they say people eat spicy food and drink hot beverages, soups, etc. in hot climates because it makes you sweat and that cools you off? I've never bought that reasoning. I mean, if you weren't hot enough to sweat to begin with, weren't you better off before? Like let's say your body temperature is hovering a fraction of a degree below the point where you start sweating. Then, you raise your body temperature by drinking a hot Chai. So you start sweating. Then a breeze comes by and that one sweaty part on your forehead feels kinda nice (evaporative cooling FTW!). But is that?really?going to make you feel better than you felt before you drank the tea?

Samsung announces ATIV S, a 48inch Windows Phone 8 device

Samsung took to the stage in Berlin to showcase its new product lineup, and one of the featured devices is the first confirmed Windows Phone 8 device. Dubbed the ATIV S, the new Microsoft-sanctioned smartphone offers a 4.8-inch screen with an HD Super AMOLED display, a 1.5GHz dual-core Qualcomm CPU, 8MP rear camera and 1.9MP front-facing cam. Additionally, it's got a beefy 2,300mAh battery, 1GB RAM, Gorilla Glass 2 and will come in both 16 and 32GB flavors. At 8.7mm, it's also reasonably thin. Its body is made of brushed aluminum and comes with a WP8-friendly MicroSD slot. We've got another pic of the ATIV S below, and we'll have a hands-on to you as soon as possible.

Los Altos Market Analysis - Silicon Valley Real Estate Blog

As shown in the charts shown below, Los Altos is a highly desirable city with a strong market and high median price range.? While it does border into a balanced market occasionally, Los Alto is to be considered predominantly a seller?s market.? Given its average median price range just under $1.6 million, it is surprising that the average DOM is under 30 days and the inventory supply is just about 1 month.? With the consistent upward trend in sales absorption and median price since September 2011, we can expect Los Altos to maintain its status as a desirable place to live and will most likely see prices continue their upward trend.

The chart shown above graphs the MSI as well as the DOM for Los Altos.? The chart indicates greater fluctuation in DOM statistics when compared with those of the Mountain View market though Los Alto does still follow the seasonal real estate cycles.? Currently, the DOM is between 20 and 30 days, and the level of inventory is currently sitting at just over one month.

As with MSI, the sales absorption rate has also been fluctuating a bit more when compared to Mountain View though it has been trending upward overall from May 2010 to May 2012.? In May 2012, the current sales absorption rate was 46.3% of properties under contract and 40.7% of properties sold.

The median price in Los Altos is showing a healthy, and likely sustainable, upward trend over the last two years.? When discussing Mountain View, Los Altos, Los Altos Hills and Palo Alto, Los Altos is the only market that did not see a dip in late 2010/early 2011. Since September 2011, this upward trend has become a bit more pronounced with the median price in May 2012 being $1,786,500 which is more than $300,000 higher than May 2010.

NATO says Afghan ally fires on coalition, kills 2

KABUL, Afghanistan (AP) ? An Afghan soldier turned his weapon on international allies in eastern Afghanistan on Monday, killing two soldiers, the NATO military coalition said.

The killings were the latest in a surge of insider attacks by Afghan forces against international troops, with 12 killed by their supposed allies this month alone. The first 10 were identified as Americans.

The morning attack happened in the eastern Laghman province, said Lt. Col. Hagen Messer of Germany, a spokesman for the alliance. NATO later said in a statement that international troops returned fire and killed the attacker. Afghan officials are investigating the shooting. The majority of troops operating in the Laghman area are American.

The soldiers were travelling in a convoy through Alingar district along with Afghan troops when one of the vehicles struck a roadside bomb, said Noor Rahman, a spokesman for the Laghman police. When the troops dismounted their vehicles, a dispute broke out and one of the Afghans fired on his coalition allies. The NATO forces then called for air support, and helicopters fired on the Afghan soldiers, Rahman said.

He added that the road has been sealed off and access to the area limited.

Insider attacks have been a problem for the U.S.-led military coalition for years, but it has exploded recently into a crisis. There have been at least 33 attacks so far this year, killing 42 coalition members, mostly Americans. Last year there were 21 attacks, killing 35; and in 2010 there were 11 attacks with 20 deaths.

Romney Tax Returns Show Strategy for Moving Money | Epou

Republican presidential candidate Mitt Romney and his wife, Ann, have used sophisticated estate- planning techniques for more than a decade to minimize taxes and amass at least $100 million for their family outside of their estate.

The couple created trusts as early as 1995, when Romney was building wealth as chief executive officer of Bain Capital LLC. They packed one for their children with investments that stood to appreciate and set up another for charity that provides a tax deduction and income. the candidate?s retirement account, valued at as much as $87.4 million, may benefit his heirs for decades.

?It?s beneficial for your kids and grandkids to push the money downstream,? said David Scott Sloan, chairman of the national private wealth services estate-planning practice at the law firm Holland & Knight LLP in Boston. ?The Romneys appear to be doing things that are similar to what other high-net-worth families do.?

Wealthy couples use strategies allowed under the federal tax system such as moving assets to trusts so that the money may be subject to little or no gift and estate taxes, Sloan said. the Romney family trust is worth $100 million, according to the campaign. that money isn?t included in the couple?s personal fortune, which the campaign estimates at as much as $250 million.

Romney?s use of the tax code to minimize levies for his family has drawn scrutiny from Democrats portraying him as an elite person of wealth who is out of touch with many Americans.

The Romneys would pay higher taxes under the estate-tax proposals of President Barack Obama and would pay less under Romney?s plan. Obama has proposed increasing the estate tax from current levels and curtailing wealth-transfer strategies. the Republican presidential candidate wants to eliminate the estate tax, which currently applies a top rate of 35 percent and a $10.24 million exemption on a married couple?s combined assets.

A repeal of the levy may save the Romneys about $70 million in federal estate taxes after they both die, assuming the couple?s combined taxable estate was $200 million after deductions for items such as administrative expenses and charitable contributions. Compared with today?s rates, Obama?s proposal may cost the Romneys an additional $20 million.

At the core of the Romneys? estate-planning strategy is a family trust. the technique pushes money out of their taxable estate and lets the couple pay the annual taxes on their family?s investment income.

The Romneys frequently spend time with their five adult sons and their families; the candidate and his wife have 18 grandchildren. the couple established the family trust in November 1995 for their children and other heirs, according to the entity?s 2010 tax return, which was made public by the candidate. Romney released an estimated 2011 income-tax return and he has said he will release the final documents when they are completed.

?Their family trusts are set up to provide for future generations,? Andrea Saul, a spokeswoman for the Romney campaign, said in a statement.

Brad Malt, a partner at the law firm Ropes & Gray LLP in Boston, manages Romney?s investments and is the trustee of the family trust. He declined to comment on the family?s estate planning.

The Romneys have transferred assets into the family trust and invested them, amassing a substantial and diversified portfolio of stocks, bonds and alternative investments such as private-equity and hedge funds that generate income. In 2010 alone, the trust realized more than $7 million in long-term capital gains, about $1.5 million in ordinary dividends and $741,407 in U.S. government interest, according to the trust?s tax return.

The family trust realized gains or losses from more than 100 securities including those in JPMorgan Chase & Co. (JPM), Bank of America Corp. (BAC), Nike inc. (NKE) and PepsiCo inc. (PEP) in 2010. it also reported investments in Goldman Sachs Group inc. (GS) hedge funds as well as interests in hedge funds and private-equity funds managed by Bain Capital, including Sankaty Advisors LLC and an affiliate based in Munsbach, Luxembourg. Because the candidate doesn?t own the trust, he isn?t required to detail its holdings on federal disclosure forms.

Romney co-founded Bain Capital in 1984. When he retired, he entered into an agreement with the Boston-based private equity firm to retain the right to make passive investments in certain Bain Capital entities until 2009, according to financial disclosures filed by his campaign.

The Romneys could have contributed as much as $1.2 million, or $600,000 each, into the family trust in 1995 and invested it in securities or funds they expected to appreciate. They wouldn?t have paid transfer taxes because that was the lifetime limit on tax-free gifts at the time. even if they contributed more money over time as Congress lifted the gift-tax exemption to the current $10.24 million for a couple, the amount they invested in securities and other assets would have grown at least 10 times to reach $100 million.

Bain Capital has seen its assets under management rise more than 16 times to $65 billion from $4 billion in 1999 when Romney left to run the Winter Olympics in Salt Lake City.

Private-equity funds pool money from so-called limited partners such as pensions, endowments and wealthy families and use that money, usually paired with debt, to buy companies they later sell. the profits are split between the limited partners, who get 80 percent, and the fund?s managers, who receive the remaining 20 percent. that portion, known as the carried interest, is considered a capital gain under current tax law. the top rate on long-term capital gains is now 15 percent.

Romney has been confronted by persistent questions about his personal finances. His 2010 return shows that he paid an effective tax rate of 13.9 percent on more than $21 million in income, most of it from capital gains and dividends. the candidate said on Aug. 16 that he had never paid less than 13 percent in the past decade and his campaign said the figure he cited represented his share of federal income tax.

Romney?s estimated $250 million in wealth is less than some of his peers who founded private-equity firms at about the same time. Stephen Schwarzman, who created new York-based Blackstone Group LP (BX) in 1985 with Peter G. Peterson, earned $398.3 million in 2006 ? the year before the firm sold shares to the public ? and held 232 million shares of the firm at the end of 2011 worth an estimated $3.14 billion as of Aug. 23. the three founders of Washington-based Carlyle Group LP (CG) each have stakes of about $1.2 billion. the trio earned $134 million each in distributions last year, according to government filings.

Wealthy investors typically will put their interests in hedge funds or private equity in a trust, or use that entity to invest in such deals directly, said Bobbi Bierhals, an estate- planning partner at the law firm of McDermott will & Emery LLP in Chicago. They usually do it when the fund has a low value because it hasn?t made investments or they haven?t prospered. that way, any future appreciation they anticipate would belong to the trust and be free of estate taxes or additional gift taxes.

Families of such wealth usually consider whether to invest with their personal money or through entities such as a trust or retirement account depending on how big a ?home run? they think the venture may be and its time frame, Bierhals said.

?You want to freeze the value,? she said. ?Put it into a pot where when you get that pop from a sale or IPO, all that additional value goes to the kids.?

In some cases, the Internal Revenue Service has challenged valuations of non-publicly traded property transferred to trusts, which can result in significant penalties and back taxes, Bierhals said. Obama?s most recent budget plan included a proposal to require consistency in valuations and restrict discounts taken when taxpayers make gifts.

It isn?t possible to determine from tax documents released by Romney?s campaign the terms of the family trust, assets gifted to it and their initial value, said Jonathan Mintz, chief operating officer at WealthCounsel LLC, a group supporting estate and business planning attorneys.

?That?s one of the real benefits of certain types of trusts and why families use them,? Mintz said. ?They are private.?

Trusts generally serve people with at least $15 million in assets because of the costs involved in setting them up, Bierhals of McDermott will & Emery said. Other political families have set up trusts to benefit future generations, including the Kennedys, according to financial disclosures.

The Romneys structured their family trust as a so-called grantor trust so they pay the tax bill on income generated inside the entity. That?s a strategy wealthy families often use, said Sloan of Holland & Knight. the assets inside the trust aren?t depleted by money paid to the government and have more potential to grow outside of the estate.

The payments aren?t considered an additional wealth transfer for gift-tax purposes, and because the Romneys have paid the levies over the years, current distributions to the children aren?t subject to income tax, he said.

Transactions like the one used by the Romneys have drawn scrutiny in Obama?s proposals to raise revenue. the president?s 2013 budget plan would reduce many of the benefits of such trusts by coordinating income and transfer tax rules including how taxes are paid and when gift-and-estate levies apply. That?s because current law ?can result in the transfer of significant wealth by the deemed owner without transfer-tax consequences,? according to the Treasury Department?s explanation of the proposals.

Romney?s individual retirement account, which he said in a financial statement filed in June is worth between $18.1 million and $87.4 million, may be used to benefit his children, said John Olivieri, a partner in the private clients group at the law firm White & Case LLP in new York.

?IRAs make great estate planning tools because heirs can stretch out the required distributions over their life expectancies,? Olivieri said. ?This is so valuable, in fact, that there was a proposal to stop it.?

When beneficiaries inherit an IRA, they are required to take distributions based on IRS tables that use life expectancies. the younger the beneficiary, the less they have to withdraw each year from the account. that can benefit children or grandchildren because assets in the IRA can continue to grow tax-deferred, said William Schmidt, a partner at the law firm Schmidt & Federico, P.C. in Boston specializing in estate planning.

Romney, 65, must take distributions from his IRA after he turns age 70? and pay ordinary income tax rates on that money he withdraws, Schmidt said. the account is subject to estate taxes, which means it?s not as tax-efficient of a wealth-transfer tool unless donated to charity, he said.

Senate Finance Committee Chairman Max Baucus, a Montana Democrat, proposed in February to require younger beneficiaries who inherit IRAs to pay taxes over five years instead of spreading them over their lifetime, which would raise an estimated $4.6 billion for the Treasury over the next decade. the plan didn?t advance.

The Romneys also set up a charitable remainder unitrust in 1996, according to state financial disclosure documents. the trust, also known as a CRUT, moves money out of an estate by donating it to charity and has two additional benefits for the creator, said John O. McManus, principal at the law firm McManus & Associates in new Providence, new Jersey, and new York.

The maker of the trust receives some tax deduction for the value that is expected to go to charity and receives payments from the trust for a set period before the assets transfer, McManus said.

?The Romneys have been extraordinarily generous in their charitable giving,? Saul, the spokeswoman, said. ?They set up a charitable trust to make a gift to charity.?

The Romneys made $7 million in charitable contributions in 2010 and 2011 combined. the couple gave $1.5 million cash in 2010 and $2.6 million cash in 2011 to the Church of Jesus Christ of Latter-day Saints, tax documents show.

Families who consistently pass money on through a variety of legal estate-planning vehicles like the Romneys can minimize taxes for their estate and future generations, Bierhals said.

?You want to combine all of those strategies to get the most runs,? Bierhals said. ?A lot of estate planning is small ball. It?s singles and doubles and every once in a while you hit a home run.?

Controlling gene expression: How chromatin remodelers block a histone pass

Two opposing teams battle it out to regulate gene expression on the DNA playing field. One, the activators, keeps DNA open to enzymes that transcribe DNA into RNA. Their repressor opponents antagonize that effort by twisting DNA into an inaccessible coil around histone proteins, an amalgam called chromatin, effectively blocking access to DNA by enzymes that elongate an RNA strand.

Both teams maneuver by chemically modifying histones?the activators by decorating histones with acetyl groups?let's call them green flags?causing them to loosen their grip on DNA. The repressors retaliate by marking histones with red flags, often methyl groups, which call in de-acetylase enzymes to clip off the green flags, restore the chromatin barrier and end that round of gene expression. Disturbing this biochemical balance lies at the heart of many diseases, particularly cancer.

Recently, the lab of Jerry Workman, Ph.D., investigator at the Stowers Institute for Medical Research, reported in the journal Nature that a reserve of "pre-acetylated" histones sits on the chromatin sidelines ready to sub for histones whose green flags get clipped by repressors, a tactic aiding the activators called "histone exchange". In a companion study published in the Aug. 26, 2012 Advance Online Publication of Nature Structural & Molecular Biology the Workman lab now shows that a repressor called Set2 in yeast recruits a protein assistant to block the histone exchange. That study reveals a heretofore unknown mechanism to keep gene activation under control and ensure that erroneous transcription does not occur.

"Accurate gene expression is critical for normal cell function, and when this control is lost cells grow abnormally," says Workman. "These two studies identify mechanisms used by cells to regulate gene expression, which is important for our understanding of what goes wrong in diseases marked by unregulated cell growth, like cancer."

The study began when the group, in collaboration with Stowers proteomics experts Michael Washburn, Ph.D., and Laurence Florens, Ph.D., applied mass spectrometry analysis to identify any protein expressed in yeast Saccharomyces cerevisiae that bound to chromatin in regions patrolled by Set2. Those regions were readily apparent by the presence of Set2's red flag methyl group planted in a specific histone protein interacting with DNA.

"We knew that Set2 added this mark in the middle and downstream parts of genes to recruit de-acetylases," says the study's lead author Michaela Smolle, Ph.D., a postdoctoral researcher in the Workman lab. "But the proteomic search allowed us to cast a wide net for other proteins associated with that mark?a bit like fishing."

Among the fish caught was a component of a yeast chromatin "remodeler" known as Isw1, providing circumstantial evidence that the Set2 red flag attracts Isw1 as well as de-acetylases. Additional genomic experiments evaluating the entire genome of a yeast mutant lacking Set2 supported that idea: not only were the red methyl flags missing but the chromatin landscape was devoid of Isw1 as well.

To assess Isw1's biological function the group exploited yet another yeast mutant, this one lacking the ISW1 gene itself. Microarray analysis of global transcription in ISW1 CHD1 mutants showed widely perturbed gene expression marked by aberrant expression of RNA snippets rather than complete transcripts. Biologists view the presence of such "cryptic transcripts" as indicators of cellular stress.

Analysis of acetylation and methylation patterns in chromatin of ISW1 mutants revealed the probable cause: mutants showed ramped up histone exchange activity marked by excessive levels green-flagged pre-acetylated histones along the length of many genes, a condition likely favoring initiation of truncated RNAs.

"Our work shows that the Set2 methylation mark plays two important roles to ensure that RNA transcription starts only at the beginning of the gene and not in the middle," says Workman. "On one hand, it recruits Isw1 to block incoming histones, and on the other it also recruits a deacetylase to remove any acetylation marks that might happen to have sneaked in."

The Workman lab uses yeast, fruit flies and mammalian cells to study multiple factors that activate and repress transcription. Thus far, they have characterized players in the repressive Set2 pathway primarily in yeast, in part because yeast represents an ideal organism for mutational analysis and has a fairly small genome?6,000 genes compared to the 25,000 or so in humans or mice.

Smolle notes that although yeast genomes are simpler, the principles that govern Set2 activity in yeast will likely hold true for its human counterparts, among them the human protein SETD2. "Yeast has a single methylase, while humans have several, and flies and humans have several Isw1-like proteins," she says. "While you cannot equate one with the other precisely, you can be reasonably sure that what happens in yeast happens in humans as well but tends to be more complicated."

Workman agrees, adding that these discoveries have significant implications for human disease. "Strikingly, the human homolog of Set2, SETD2, is implicated as a tumor suppressor in breast cancer and in renal carcinoma, and those cells are deficient in the SETD2 methylation mark," he says. "These findings strongly suggest that SETD2 could be important in controlling cell growth and preventing tumors. Thanks to yeast, we now know more about how Set2 does that."

Japan yens for Reese's Peanut Butter Cups

TOKYO (Reuters) - Americans have enjoyed Reese's Peanut Butter Cups since 1923, but until now devotees in Japan had to buy them on U.S. military bases, carry them back in suitcases or resort to making their own homemade versions of the popular treat.

That changed this spring when Seiyu GK, the Japan arm of Wal-Mart Stores Inc, began selling the chocolate and peanut butter Reese's under an exclusive one-year distribution agreement with Hershey Co.

The products are the same as those sold in the United States, minus a preservative not approved for use in Japan.

Seiyu's research led the company to conclude it would find fans here for the candy in the distinctive orange wrapper.

"We've decided to sell them in Japan because there were customers' opinions such as 'being addicted,'" said a Seiyu spokeswoman.

Based on their initial reception, Reese's Peanut Butter Cups are likely to be in Japan to stay.

Seiyu's first-month sales amounted to 1.7 times more than Kit-Kat Mini, which had been the most popular product in the store's chocolate line-up until then, the spokeswoman said.

Seiyu has no breakdown of customer profiles, but "addicted" expatriates accounted for some of the sales.

"As soon as I came to Japan, and couldn't find them, I was ready to pay crazy amounts of money just to get them," said 36-year old John-Mark Kuba. The Hawaii native came to Japan in 2005 and works as an assistant language teacher at a junior high school in Tokyo.

When he spotted them on a shelf in a Seiyu store in suburban Tokyo's Ogikubo, he said he couldn't believe it, adding: "It seemed so out of place."

Kuba promptly snapped up three packages containing a total of 18 large Peanut Butter Cups.

NO TBHQ

About 85 percent of Hershey's sales are from the U.S. market, but it expects international net sales to rise to about 20 percent of total sales by 2017.

"Our desire to grow internationally was well timed with Walmart's desire to expand their sales of our most iconic products across their global store footprint," Hershey spokesman Jeff Beckman wrote in an email.

Hershey's produces Japan's Peanut Butter Cups in the U.S. for export. While the company doesn't comment on product formulation, Beckman said the Reese's products sold in Japan are identical to those sold at Walmart stores in the United Kingdom, South Africa and Latin America.

One difference between the export version and the one sold in the U.S. is apparent from comparing labels. The Reese's sold abroad do not list "TBHQ," which is shorthand for tertiary butylhydroquinone, a preservative.

The U.S. Food and Drug Administration allows its use, but it hasn't been approved in some other countries, including Japan.

Excluding the TBHQ means avoiding the headaches faced by Japan's Duskin Co a decade ago, when it admitted its Mister Donut subsidiary had sold imported pork buns containing the additive. The revelation and ensuing scandal led the company's president to resign, and a shareholder to file a lawsuit.

Anesthesia in young kids may carry developmental risks | Health X ...

While surgery carries risks for anyone, ?going under? can have some particular risks for the very young. A study coming out in the September issue of Pediatrics finds that children who have anesthesia before the age of 3, are at a higher risk for?developmental delay issues later in life. The study looked at more than 2,600 children in Australia who were tracked as part of the Raine Study . Authors found that by the age of 10, children who?d been exposed to anesthesia at a young age were more than twice as likely to have developmental issues with listening and speaking comprehension. "We can?t determine if the cause is due to anesthesia, surgical stimulus, or the medical condition. It could be another factor entirely. We just know there?s a difference,? says?Dr. Caleb Ing, assistant professor of pediatric anesthesiology at Columbia University Medical Center and lead author of the study. Dr. David Warner, professor of anesthesiology at Mayo Clinic, has also been studying the impact anesthesia has on development. While he was not part of this study, Warner agreed that surgery and anesthesia introduce a whole host of factors that may impact a child?s developmental outcome. ?It may be the surgery; it could be the underlying illness,? explained Warner. Previous studies have linked anesthesia in young children to increased risks in learning disabilities and ADHD . However this is the first study that has used a battery of neuropsychological tests to determine developmental delay. Previous studies relied on test scores, physician?s diagnoses ?and medical records. The children in the study were given tests that assessed?their listening, speaking, and abstract reasoning skills. Children who had had anesthesia were 1.87 times more likely to have listening comprehension issues, 1.72 times more likely to have problems with speaking and 1.69 times more likely to have abstract reasoning delays. The combined risk factor for both listening and speaking issues was 2.11. The group was also tested for behavior and motor function, but the authors found no significant difference in these skills between children who?d had anesthesia and those who hadn?t. The authors also compared children who had anesthesia once, versus 52 children in the study group who had it multiple times. ?We did see a difference in children with single and multiple exposure, but we couldn?t statistically prove a difference, because we need more patients that had multiple exposures than were available in this study,? said Ing. But while there are risks, Ing also warned that further study needs to be done. ?We don?t enough evidence to change our current practices,? he explained. ?Anytime you decide to do a procedure, you need to understand what the real benefits are," Warner says. "Parents need to ask, 'Do we really need to do this? How is this going to benefit my child?' In the vast majority (of cases), in kids this age, the benefits are real. But the risk is potential and not definite." He added, ?It?s been established as a risk factor, and needs to be part of the conversation as parents talk to their doctors.?
